According to a press release issued by the Southern Poverty Law Center on Friday, the new law “endangers public safety, invites the racial profiling of Latinos, Asians and others who appear foreign to an officers, and interferes with federal law.” An official suit has been filed with the U.S. District Court for Northern Alabama.
The law, known as HB 56, is set to take effect September 1 after being signed and passed by Gov. Robert Bentley last month. The bill requires law enforcement officers “to attempt to determine the immigration status of a person who they suspect is an unauthorized alien of this country,” per a fact sheet presented by the Alabama House Republicans, which is similar to a provision that was recently struck by a federal judge from a Georgia immigration law. The bill also makes it a criminal offense to house or transport an illegal immigrant.
Despite the lawsuit, a spokeswoman for Bentley said the legislature and governor stand behind the bill.
